(Washington) The Senate confirmed the first choice of judge of President Donald Trump for his second term, approving Whitney Hermandorfer as a judge of the Sixth Circuit of the United States.

Confirmation of mme Hermandorfer, who worked for the attorney general of Tennessee, intervenes after the Senate, dominated by the Democrats under former president Joe Biden, confirmed 235 Federal judges and that the Senate, dominated by the Republicans under the first mandate of Donald Trump, confirmed 234.

The two presidents each worked at the overhaul of the judicial system, Donald Trump taking advantage of the high number of vacant posts at the end of Barack Obama’s mandate, while the Democrats were trying to surpass the number of judges of Donald Trump after he had the opportunity to appoint three judges to the Supreme Court.

For the moment, during his second term, Donald Trump has fewer vacant positions to be filled. Although he inherited more than 100 vacant seats by President Obama, blocked by a Republican Senate in his last two years, Donald Trump has now had 49 vacant seats to be filled on nearly 900 federal judges.

The head of majority in the Senate, John Thune, explained last week that the Senate would try to quickly confirm the judicial appointments of Donald Trump, even if “we are not confronted with the same number of vacancies at Congress as in Mr. Trump’s first mandate”.

Mme Hermandorfer, confirmed by 46 votes to 42, according to the party lines, defended many policies of Donald Trump as director of strategic litigation of the attorney general of Tennessee, in particular his attempt to end the law of the soil. Democrats and Defense groups for progressive justice rights have criticized him for his extreme on this issue and others, also citing defense by his office of the strict prohibition of abortion in the state.

Before working for the attorney general of Tennessee, she was assistant to three judges from the Supreme Court. But during his confirmation hearing last month, the Democratic Senator Chris Coons of Delaware criticized what he described as “striking brevity” of the judicial experience of Mme Hermandorfer since obtaining his law diploma ten years ago.

The Senator of Illinois Dick Durbin, the main democrat of the Senate judicial commission, said on Monday that Donald Trump focused solely on “the perceived loyalty of a candidate for him and his program, and his desire to rule in his favor and that of his administration”.

The Judicial Commission must vote for new judges this week, including Emil Bove, senior official of the Department of Justice and former lawyer for Donald Trump, appointed to the Court of Appeal of 3e United States circuit. The appointment of Mr. Bove was scrutinized after a lawyer for the dismissed department said in a complaint that Mr. Bove had used a juron when he had declared, at a meeting, that the Trump administration could be brought to ignore the judicial injunctions. Mr. Bove rejected the suggestions of the Democrats that the declarations of the whistleblower would make him unfit to sit on the federal magistracy.

Emil Bove also accused FBI officials of “insubordination” for refusing to hand over the names of the agents who investigated the riot of the American Capitol and ordered the dismissal of a group of prosecutors involved in the criminal affairs of January 6.
