A Florida woman has filed a $5 million lawsuit against Hershey after the company allegedly “deceived” her with “deceptive” packaging for seasonal Reese’s chocolates.
Cynthia Kelly of Tampa claimed the shapes of the chocolates shown on the packages did not match those of the products – including pumpkins, ghosts, footballs, bats, snowmen and candy bars. bell-shaped.
“The Hershey labels for the products are materially misleading and many consumers have been deceived and misled by the images on the product packaging,” it is written in the documents filed with the court seen by the New York Post.
The American decided to continue the business after purchasing pumpkin-shaped chocolates. She said she was disappointed not to see the eyes and mouth carved into the chocolates, as shown on the packaging. She also added that she would not have purchased the product which sold for USD 4.49 if she had seen that the label details were not there.
The class action, if successful, will affect “all consumers in Florida who purchased any of the products.”
