(Washington) An American court of appeal confirmed on Thursday a first instance decision ordering the Trump administration to resume passport issuing with the “X” genre or a different genre from that of birth for transgender or non-binary people.

Donald Trump signed on January 20, his inauguration day, a decree according to which only two genres-masse and women would now be recognized in the United States.

The State Department had ceased in the process of delivering passports with the genre “X” or a different genre of the kind of birth of the holders, in application of this decree.

But an American judge had ordered the administration in June to resume their delivery.

A Court of Appeal rejected the government’s request to suspend this decision on Thursday, confirming the conclusion of the court of first instance according to which affected persons will suffer “various immediate and irreparable damages” due to Donald Trump’s decree.

The first American passport with genre “X” had been issued in October 2021 by the State Department, which had specified that the “X” box was reserved for “non-binary people, intersex” and more broadly those who do not recognize themselves in the genre criteria offered until then.
