(Washington) A Salvadoran immigrant who is expressed by mistake and then brought back after months of judicial guerrilla warfare in the United States, where he is now accused of having transported illegal migrants, asked on Friday an extension of his detention, for fear of being expelled as soon as he releases.
The case of Kilmar Abrego Garcia, resident of Maryland (east) married to an American, crystallizes the opposition between federal justice, including the Supreme Court, and the Executive, accused of obstruction vis-à-vis the courts which contradict its policy of mass expulsions.
After declaring himself unable to bring Kilmar Abrego Garcia, expelled to Salvador on March 15 with more than 250 men, most of all for membership allegedly to a Venezuelan gang, the Trump administration brought him back to the United States on June 6. But she immediately announced that he was now prosecuted for migrant trafficking.
An US Federal Judge of Nashville (South) rejected detention on the basis of these criminal proceedings and set the Liberation conditions on Wednesday. She also specified that Kilmar Abrego Garcia was accused of helping the illegal stay, but no “traffic” of migrants.
But the latter’s lawyers officially asked the judge on Friday to stay this release until a hearing in this file on July 16, saying to themselves “well aware of the paradoxical nature of this request”.
They argue in particular that the representatives of the government mentioned in front of another court the day before “to expel Mr. Abrego to a third country” once it has been released and claim “not being able to grant any credit to the declarations of the Department of Justice in this file”.
For its part, the government recalls that it did not have mystery of its desire to resume the procedure for the expulsion of Kilmar Abrego Garcia if he was released, but indicates that he does not oppose this extension of his detention.
Donald Trump erected the fight against illegal immigration in absolute priority, evoking an “invasion” of the United States by “criminals from abroad” and communicating abundantly on the expulsions of immigrants.
But his massive expulsion program was thwarted or slowed down by multiple court decisions, in particular on the grounds that the people targeted should be able to assert their rights.
