(Washington) An American judge ordered the Trump administration on Tuesday to resume passport issuance with the genre “X” or a different genre from that of birth for transgender people or identifying themselves as non -binary, interrupted since January.
The US State Department announced at the end of January that it ceased to issue passports with the genre “X” or a different genre of the kind of birth of the document, in application of a decree taken by President Donald Trump from the first day of his mandate.
A Federal Judge of Boston (northeast) had concluded in April that the decree of the decree and the policy of deliverance of passports which result from it.
It had consequently suspended this change for the benefit of six transgender complainants or which define themselves as non -binary (neither strictly man nor strictly woman).
The judge goes further Tuesday by extending this suspension to all transgender or non -binary people affected by the change of policy.
It therefore orders the State Department to resume the issuance of these passports until a judgment on the merits or a contrary decision of the court or a superior jurisdiction.
“The conservatory measure granted by this court is closely defined to only benefit from Americans whose rights have probably been violated by the policy of delivery of passports and who without it would likely undergo irreparable damage,” she writes.
Donald Trump signed on January 20, the day of his inauguration, a decree ordering his administration to “recognize” the existence of only “two sexes” defined at birth.
“From today, the official policy of the United States government will be that there are only two sexes, male and female,” said the republican president.
He thus returned to a reform introduced under his Democratic predecessor Joe Biden.
The first American passport with genre “X” had been issued in October 2021 by the State Department, which had specified that the “X” box was reserved for “non -binary people, intersex” and more broadly those who do not recognize themselves in the genre criteria offered until then.
During his campaign, Donald Trump promised to end the “transgender delirium” in the United States.
